“Sleeper Law” No. 6 — Bill ups limit of non-taxable fundraising sales by educational nonprofit organizations

“Sleeper Law” No. 6 — Bill ups limit of non-taxable fundraising sales by educational nonprofit organizations

By Denise Dittrich, MSBA Associate Director of Government Relations

This one you won’t hear reported on the five o’clock news, but it will save educational nonprofits some money and provide peace of mind. HF 3167 increases the annual limit of non-taxable fundraising sales by educational nonprofit organizations from $10,000 to $20,000, effective for sales after December 31, 2014. This bill also defines what constitutes a “fundraising day” which has never been defined in statute before. This definition excludes ongoing sales in stores and restaurants, ongoing sales over the Internet and regularly scheduled classes or activities that are part of the nonprofit’s normal course of business. This new law is effective immediately.
